The gist:
- We provide a free music streaming service
- You can listen as much as you want
- Don't try to break or abuse our service
- We're not responsible if your cat doesn't like our music selection
- The music is for streaming only, not downloading
- We might change things occasionally

1. ACCEPTANCE OF TERMS
By accessing or using Now Wave Live (the "Service"), including our website at nowwave.live and our mobile applications, you agree to be bound by these Terms of Service ("Terms"). If you don't agree with these Terms, please don't use our Service. We'll be sad to see you go, but we respect your choice.
These Terms constitute a legally binding agreement between you and Now Wave Radio, LLC ("Now Wave," "we," "us," or "our").
Plain English: Using our service means you agree to these rules. Think of it like entering a concert venue — there are some basic expectations for everyone.
2. SERVICE DESCRIPTION
Now Wave Live is a free internet radio streaming service. We broadcast a curated selection of music 24/7 through our website and mobile apps (iOS and Android). That's what we do, and we love doing it.
What We Provide
- Live audio streaming of music programming
- Information about currently playing tracks
- Access to archived shows (via Mixcloud)
- Show schedules and DJ information
- The occasional witty banter from our DJs
What We Don't Provide
- Music downloads or offline listening
- On-demand song selection (we're radio, not a jukebox!)
- Guaranteed uptime (stuff happens, we're human)
- Music recommendations based on your listening habits (we don't track that)
The Service is provided free of charge. We may offer additional features, merchandise, or accept donations, but the core streaming service will always be free.
3. USER ELIGIBILITY
You may use Now Wave Live if you are:
- 13 years or older, or
- Under 13 with verifiable parental or guardian consent
If you're under 18, we encourage you to review these Terms with a parent or guardian. Our music programming may occasionally include content with mature themes, as is common with radio broadcasting.
By using the Service, you represent that you meet these eligibility requirements.
4. YOUR USE OF THE SERVICE
We want you to enjoy Now Wave Live! Here's what you're welcome to do:
- Listen to our streams for personal, non-commercial enjoyment
- Share links to our website or apps with friends
- Contact us with song suggestions, feedback, or just to say hi
- Adjust your volume (we can't control your speakers, that's on you)
- Dance (optional, but encouraged)
You are responsible for obtaining and maintaining any equipment and internet access necessary to use the Service. We can't help if your Wi-Fi is spotty or your headphones are tangled.
5. PROHIBITED CONDUCT
While we're pretty chill, there are some things that aren't cool. Please don't:
- Hack, attack, or attempt to circumvent our security measures
- Use automated systems (bots, scrapers, etc.) to access the Service
- Redistribute, rebroadcast, or re-stream our content without permission
- Record or download our streams for redistribution
- Interfere with other users' enjoyment of the Service
- Impersonate Now Wave staff, DJs, or other users
- Use the Service for any illegal purpose
- Attempt to reverse engineer our apps or infrastructure
- Overload our servers with excessive requests
- Claim our content as your own (that's just not nice)
Violations may result in termination of your access. Don't make us be the bad guys.
6. INTELLECTUAL PROPERTY
Music Content
The music we stream is licensed through various performance rights organizations and licensing agreements. We don't own the music — the artists, labels, and songwriters do. We have the necessary licenses to stream it to you, but those licenses don't extend to you recording, downloading, or redistributing the content.
Our Branding
The Now Wave name, logo, graphics, and website design are owned by Now Wave Radio, LLC and are protected by trademark and copyright laws. Please don't use our branding without permission.
User Submissions
If you send us song suggestions, feedback, voicemails, or other content ("User Content"), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with the Service. This includes potentially playing your voicemail on air (which is awesome, by the way).
You represent that you own or have the rights to any User Content you submit, and that it doesn't violate anyone else's rights.
7. DMCA / COPYRIGHT POLICY
We respect intellectual property rights and expect our users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws.
DMCA Takedown Notices
If you believe that content on our Service infringes your copyright, please send a written notice to our designated agent that includes:
- Your physical or electronic signature
- Identification of the copyrighted work you claim has been infringed
- Identification of the material you claim is infringing and where it's located on our Service
- Your contact information (address, telephone number, email)
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf

Counter-Notification
If you believe your content was wrongly removed due to a DMCA notice, you may submit a counter-notification containing:
- Your physical or electronic signature

- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
- Your name, address, telephone number, and consent to jurisdiction of federal court in Washington State
Repeat Infringers
We reserve the right to terminate accounts or access of repeat copyright infringers.
8. THIRD-PARTY CONTENT & LINKS
Our Service may contain links to third-party websites, apps, or services (like our Mixcloud archives, social media pages, or PayPal for donations). These are provided for your convenience, but we don't control them and aren't responsible for their content, privacy practices, or terms of service.
When you leave Now Wave Live for a third-party site, you're subject to that site's terms and policies. We recommend reading those too (we know, so much reading).
The inclusion of any link doesn't imply endorsement by Now Wave Radio, LLC.
9. DISCLAIMERS
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by law, Now Wave Radio, LLC disclaims all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties that the Service will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy or reliability of any content
- Warranties that the Service will meet your requirements
We do our best to keep things running smoothly, but sometimes servers hiccup, streams buffer, and gremlins get into the equipment. We can't guarantee perfection.
Plain English: We provide the service as-is. We hope it works great (and it usually does!), but we can't promise it will work perfectly 100% of the time.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOW WAVE RADIO, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
This includes, but is not limited to:
- Loss of profits, data, or goodwill
- Service interruption or computer damage
- The cost of substitute services
- Any damages arising from your use or inability to use the Service
In any case, our total liability to you for all claims arising from the Service shall not exceed the amount you paid us in the past twelve months (which, since the service is free, would be $0).
Some jurisdictions don't allow certain liability limitations, so some of the above may not apply to you.
11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Now Wave Radio, LLC, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any User Content you submit
Plain English: If you break the rules and we get sued because of it, you're responsible for helping us out with that.
12. TERMINATION
We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without notice. This includes, but is not limited to, violations of these Terms.
You may stop using the Service at any time. Just close the app or website. No cancellation process needed — you're not locked in.
Upon termination, the provisions of these Terms that by their nature should survive (like Disclaimers, Limitation of Liability, and Indemnification) will remain in effect.
13. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law principles.
Any legal action arising from these Terms or your use of the Service shall be brought exclusively in the state or federal courts located in Washington State, and you consent to the personal jurisdiction of such courts.
14. DISPUTE RESOLUTION
We'd prefer to work things out amicably. If you have a concern or dispute, please contact us first at [email protected]. We'll do our best to resolve issues informally before anyone lawyers up.
If informal resolution isn't possible, any disputes shall be resolved through the courts as described in Section 13 (Governing Law).
15. CHANGES TO TERMS
We may update these Terms from time to time. When we do, we will:
- Update the "Last Updated" date at the top of this document
- For significant changes, provide notice through the Service or our website
- Continue our tradition of making legal documents actually readable
Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you don't agree to the new Terms, please stop using the Service.
We encourage you to review these Terms periodically. We promise to keep them as human-readable as possible.
